These Forum Terms of Service ("Forum Terms") govern your use of the Online Support Group Program and all support groups ("Forums") operated by Cancer Care, Inc. ("CancerCare," "we," and "our"). These Forum Terms represent a binding contract between CancerCare and you. By creating an account or otherwise accessing the Forums, you expressly represent that you are legally competent to enter into this agreement and agree to be bound by these Forum Terms.
Importantly, your use of the Forums is also governed by CancerCare's general website Terms of Service ("Website Terms"), available here , which apply to all portions of www.cacnercare.org and any other online properties operated by CancerCare (the "Sites"). Please review the Website Terms before using the Forums. They contain important provisions that affect your legal rights, including provisions that limit our liability in connection with the operation of the Sites and require binding individual arbitration for the resolution of disputes regarding your use of the Sites. If you do not agree to any provision of the Website Terms, please do not use the Forums or any other portion of the Sites.
Registration:
CancerCare's Online Support Groups are a private, subscription only program. All of our support groups are closed to non-members. To become a member of a Forum, please fill out your information and select the group that best fits you. You will receive enrollment confirmation or follow-up via our secure message center. When you register, you need to choose a unique "user name" and you must provide a unique, valid email address. Duplicate user names and email addresses are not allowed, so if the name or address you enter is already in use, you will be prompted to choose another one.
Disclaimer Regarding Forum Contents:
The Forums will allow users to submit, post, link, share and otherwise make available information, text, graphics, videos, or other content. Any message posted on our Forums expresses only the views of the author of the message and does not necessarily reflect the views of CancerCare. Therefore, you agree that CancerCare will not be held responsible for the contents, accuracy, completeness or validity of any information posted in the Forums.
Further, information posted in the Forums should not be considered professional medical advice, nor should this information be treated as a substitute for professional medical advice, diagnosis, or treatment. You should always seek the advice of your physician or other qualified health care provider for any questions regarding a medical condition or treatment and before making any health care decision. Never disregard professional medical advice or delay in seeking medical advice or treatment because of something you read on the Forums. If you are experiencing a medical emergency, you should not rely on any information on the Forums and should seek appropriate emergency medical assistance, such as by calling "911".
Rules of Conduct & Content Removal
By participating in the Forums, you agree not to:
- Use language that is, or post materials that are, defamatory, abusive, profane, threatening, or otherwise offensive.
- Post any commercial messages on the Forums or use the Forums in connection with surveys, contests, pyramid schemes, chain letters, junk email, spamming or any other duplicative or unsolicited messages.
- Impersonate any person or entity while using the Forums.
- Post any copyrighted material without the express permission of the copyright holder, or otherwise post any material that violates the intellectual property rights (including, without limitation, trademark and publicity rights) of another party.
- Violate, or encourage others to violate, any applicable laws while using the Forums.
CancerCare reserves the right, but expressly disclaims any obligation, to monitor the Forums to determine compliance with these Forum Terms and the Website Terms. CancerCare reserves the right to edit and/or remove any content that we determine to be in violation of these Forum Terms or the Website Terms, or that we otherwise deem to be inappropriate for the Forums, all as determined by CancerCare in its sole discretion.
Any user who believes that a posted message is objectionable is encouraged to contact us by email. Forums will provide a moderator's email address. Upon receipt of such notification, we will make every effort to take such action as we deem necessary within a reasonable period of time. If we determine that the content in question should be removed, please be advised that we may not be able to remove or edit it immediately. By participating in the Forums, you release CancerCare from any and all liability associated with decisions to remove, or not remove, any content.
You agree that you are solely responsible for the content you post to the Forums. You agree to indemnify and hold CancerCare harmless from and against any and all liabilities, claims, damages, costs, and expenses, including attorneys' fees and costs, arising from or related to your misuse of the Forums or any breach by you of these Forum Terms.
Confidentiality:
Information posted by other users in the Forums must be treated as confidential. This means that you may not post or otherwise share such information without the express, written permission of the user who posted the content. We reserve the right to terminate your access to the Forums if you violate this confidentiality requirement. At the same time, while we intend for the Forums to be a safe and inclusive environment for mutual support, we ultimately have limited control over how users treat the contents of the Forums. As such, you acknowledge and agree that CancerCare shall have no liability to you or any third-party if another user violates this confidentiality requirement and impermissibly shares information that you post to the Forums.
Notwithstanding any other provision in these Forum Terms, CancerCare reserves the rights to reveal your identity or share content that you posted to the Forums as necessary, in CancerCare's sole discretion to resolve any disputes or comply with any government or law enforcement processes concerning your use of the Forums.
